TERMS & CONDITIONS

These Standard Trading Conditions govern all commercial road freight, heavy haulage, flatbed and reefer transport, GCC cross-border transit, and auxiliary logistics services provided by Sky Hope Transport (hereinafter referred to as "the Carrier" or "Company") to any individual, business, contractor, or corporate entity (hereinafter referred to as "the Shipper", "Customer", or "Client").

• "Carrier": Sky Hope Transport, including its fleet, drivers, authorized operators, and logistics partners.
• "Consignment": All goods, industrial materials, machinery, reefer perishables, or containers handled on behalf of the Shipper.
• "Waybill / Consignment Note": The official proof of receipt and delivery document generated for every transport mission.

All rate estimates and commercial freight proposals issued by Sky Hope Transport are subject to equipment availability, route feasibility, and current regulatory permits at the time of confirmed dispatch.

• Quotation Validity: Official spot quotes remain valid for 14 calendar days from the date of issue unless otherwise specified in writing.
• Booking Authorization: Dispatch scheduling requires written confirmation via official email, signed quotation, or approved digital purchase order.
• Route & Fleet Reallocation: The Carrier reserves the right to select the most safe and efficient route and trailer specifications suitable for the cargo.

The Shipper guarantees that all cargo details, dimensions (length, width, height), gross weight, and material nature provided prior to dispatch are precise, complete, and legally compliant with UAE Federal road weight restrictions.

• Adequate Packaging: Cargo must be securely packed, banded, palletized, or crated to withstand normal transit vibrations, braking forces, and highway conditions.
• Oversized / Heavy Lift Cargo: For out-of-gauge (OOG) machinery, the Shipper must provide certified center-of-gravity and lashing point schematics in advance.

To maintain maximum fleet operational efficiency and punctual delivery schedules across the GCC network, strict turnaround protocols apply at all loading docks and receiver yards.

• Free Loading & Unloading Time: Standard trailers (Flatbed, Curtainside, Box) include 3 hours free time at origin and destination. Heavy lowbed and multi-axle trailers include 4 hours free time.
• Demurrage Charges: Waiting time exceeding the allowable free period will be invoiced at standard hourly detention rates or agreed daily standby tariffs.
• Safe Site Access: The Shipper and Consignee must ensure safe, unobstructed paved road access, certified crane/forklift equipment, and qualified rigger staff at pickup and discharge points.

All invoices issued by Sky Hope Transport are priced in UAE Dirhams (AED) or Saudi Riyals (SAR) as agreed upon quotation confirmation, exclusive of applicable UAE Value Added Tax (VAT 5%).

• Standard Payment Terms: Spot transport orders require full prepayment or cash against delivery (CAD). Approved corporate credit accounts operate on agreed 30-day or 45-day billing cycles.
• Tolls, Permits & Escorts: Salik tolls, special highway oversize RTA/police escort permits, and port gate pass tariffs are billed strictly in accordance with quotation agreements.
• Right of Lien: The Carrier maintains a general and particular legal lien over any cargo in transit or storage for unpaid freight charges or accrued detention dues.

Sky Hope Transport adheres to the highest fleet maintenance and driver safety standards. Carrier liability is governed strictly by the UAE Commercial Transactions Law (Federal Law No. 50 of 2022) and international road transport conventions.

• Liability Cap: Carrier liability for loss or physical damage to cargo caused by proven Carrier negligence shall not exceed statutory statutory limits per kilogram or agreed consignment limits.
• All-Risk Marine/Cargo Insurance: For ultra-high-value consignments, industrial transformers, or specialized machinery, the Shipper is strongly advised to obtain all-risk cargo insurance covering 100% of commercial invoice value.
• Claim Notification Period: Visible damage must be endorsed on the physical/digital Proof of Delivery (POD) immediately upon handover. Concealed damage claims must be lodged in writing within 7 business days.

For freight moving across borders into the Kingdom of Saudi Arabia (KSA), Oman, Qatar, Kuwait, or Bahrain, the Shipper is solely responsible for ensuring all export/import documentation complies with GCC Unified Customs regulations.

• Mandatory Customs Documentation: Original Commercial Invoices, Attested Certificates of Origin, Packing Lists, Bayan Customs Declarations, and SABER / SASO conformity certificates (for Saudi Arabia).
• Customs Duty & Border Fees: All destination customs tariffs, import taxes, port inspection charges, and customs broker clearance fees are payable directly by the Shipper or Consignee.
• Border Clearances Delays: The Carrier shall not be held liable for border transit delays resulting from customs inspection queues, missing paperwork, or regulatory system downtime.

Safety is the foundational principle of our logistics operations. Sky Hope Transport operates under zero-compromise adherence to UAE Ministry of Energy & Infrastructure and GCC transport safety mandates.

• Prohibited Cargo: Weapons, illegal substances, undeclared hazardous chemicals, unauthorized radioactive materials, or contraband of any nature are strictly rejected.
• Dangerous Goods (ADR / IMO): Authorized chemical consignments require prior written approval, Material Safety Data Sheets (MSDS), UN hazard class labeling, and specialized DG-certified drivers.
• Driver Authority: Our licensed drivers maintain full authority to stop operations or refuse transit if site loading methods create highway safety hazards.

Neither party shall be held liable for delivery schedule failures, route diversions, or temporary service suspensions caused by occurrences beyond reasonable operational control (Force Majeure events).

• Force Majeure Events: Acts of God, severe weather anomalies (dense desert fog, sandstorms, flash floods), official road/bridge closures by police or RTA, civil unrest, border system shutdowns, or pandemic restrictions.
• Order Cancellation Terms: Cancellation of scheduled trailers after driver dispatch or vehicle positioning at origin is subject to a standard cancellation / deadhead haulage fee.

These Terms & Conditions and all commercial transport agreements entered into with Sky Hope Transport shall be governed by and interpreted exclusively in accordance with the laws of the Emirate of Dubai and the Federal Laws of the United Arab Emirates.
